It contains the rights people have regarding the software, often limiting those rights as much as possible. It\u2019s being a contractual document, Eula\u2019s often contain a lot of legal jargon, which usually is gibberish to ordinary human beings. The question is, do they have to be this difficult to read?<br><br>I\u2019m not going to answer that question of course, since I\u2019m no legal expert, but readability \u2013 which happens to be a part of usability \u2013 is part of my expertise. It can be measured. Many scientists studying language have come up with formula\u2019s to calculate the level of difficulty of a particular piece of text. The most well known of these scientists is Mr. Flesch who invented the Flesch Reading Ease test. The result was the following formula:<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img src=\"https:\/\/web.archive.org\/web\/20100110070611im_\/http:\/\/upload.wikimedia.org\/math\/4\/e\/0\/4e00010b3dbb079fb3c8ab74482b9bef.png\" alt=\"Flesch Reading Ease Formula\" title=\"The Readability of the EULA\"\/><\/figure>\n\n\n\n<p>The results from this formula come in categories:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><th>Score<\/th><th>Notes<\/th><\/tr><tr><td>90.0\u2013100.0<\/td><td>easily understandable by an average 11-year-old student<\/td><\/tr><tr><td>60.0\u201370.0<\/td><td>easily understandable by 13- to 15-year-old students<\/td><\/tr><tr><td>0.0\u201330.0<\/td><td>best understood by university graduates<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>This table showed you that the higher the score, the easier the read\u2026 (source of both formula and table is&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20100110070611\/http:\/\/en.wikipedia.org\/wiki\/Flesch%E2%80%93Kincaid_readability_test\">Wikipedia<\/a>)<\/p>\n\n\n\n<p>Luckily there are tools to calculate the score on your texts (like&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20100110070611\/http:\/\/flesh.sourceforge.net\/\">this&nbsp;<\/a>one which was used to calculate the values below) and even websites like&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20100110070611\/http:\/\/www.addedbytes.com\/tools\/readability-score\/\">this<\/a>&nbsp;one. (And also note that there are other ways to calculate readability which I\u2019ve kept out of this article to keep some readability\u2026)<\/p>\n\n\n\n<p>Let\u2019s get back to the Eula. Is it any good, Is it readable and how do different Eula\u2019s compare?&nbsp;I created this little table for your enjoyment:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><th>Eula<\/th><th>Score<\/th><\/tr><tr><td>GPL v2<\/td><td>46,26<\/td><\/tr><tr><td>Apache<\/td><td>31,49<\/td><\/tr><tr><td>Microsoft Windows XP EULA<\/td><td>25,26<\/td><\/tr><tr><td>GPL v3<\/td><td>39,41<\/td><\/tr><tr><td>BSD simplified FreeBSD<\/td><td>27,48<\/td><\/tr><tr><td>MPL (Mozilla)<\/td><td>32,64<\/td><\/tr><tr><td>MS-PL Microsoft Public License<\/td><td>40,80<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>As you can see, the most readable license in this list is the GPL v2. The worst is the Microsoft EULA for Windows XP. Interestingly, the very open BSD license in it\u2019s simplified FreeBSD version doesn\u2019t do much better than the MS Eula. Also note that the Microsoft Public License isn\u2019t that bad a read, meaning that you don\u2019t need to be a MSc to understand what it tells you. &nbsp;Since I didn\u2019t check every license in the world, this is just an indication. Just leave your comment and I\u2019ll update the table (when I find time to do so\u2026)<\/p>\n\n\n\n<p>An interesting question is the following legal one (please leave your comments!): If a license requires you to have more education than you actually have, can you actually be bound by it\u2019s terms? In other words: If you can\u2019t understand because they made it too hard, and you still accept, are you bound to it? And how about: Do we need to force companies to create their license documents with a minimum Flesch Reading Ease score of 60? Should we have a law about that? Should an \u2018average\u2019 person be able to understand this sort of documents since that same average person is also using the software? Should licenses be written in a way that helps the reader and user of the software? I think they should, How about you?<\/p>\n\n\n\n<p>to further compare free licenses on other characteristics a good source to look is&nbsp;<a href=\"https:\/\/web.archive.org\/web\/20100110070611\/http:\/\/en.wikipedia.org\/wiki\/Comparison_of_free_software_licences\">this<\/a>&nbsp;one.<\/p>\n\n\n\n<p>I am currently not aware of tools and formula\u2019s to calculate readability in other languages than English.
